1. Agreement to these Terms
These Terms of Service (“Terms”) form an agreement between you and MOIM PTY LTD (“MOIM”, “we”, “us”) when you access or use the MOIM app, website or related services. By creating an account or using MOIM, you agree to these Terms, our Privacy Policy and our Community Guidelines.
If you do not agree, do not use MOIM.
2. Eligibility and age
In Australia, you must be at least 16 years old to create a MOIM account. In other regions, you must meet the minimum age required by local law and, in all cases, be at least 13 unless a higher age applies.
You must have legal capacity to agree to these Terms. If you use MOIM on behalf of a business, association or other organisation, you represent that you are authorised to bind or act for that organisation in relation to the features you use.
3. Accounts and account security
- Provide accurate information and keep your account details reasonably up to date.
- Keep your sign-in credentials secure and do not share one-time codes or recovery credentials.
- You are responsible for activity carried out through your account unless it results from a failure by MOIM to use reasonable security measures.
- Do not create accounts to impersonate another person, evade restrictions, mislead users or interfere with moderation.
- Tell us promptly if you believe your account has been compromised.
4. Your content and permissions you give us
You retain ownership of content you create and submit to MOIM, subject to any rights belonging to other people or organisations.
To operate MOIM, you grant MOIM a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display, transmit and make technical copies of your content only as reasonably necessary to provide, secure, moderate and improve the service. This licence ends when the content is deleted from our active systems, except to the extent a copy must be retained for backup, safety, legal or dispute purposes.
You are responsible for ensuring that content you submit does not infringe another person’s rights or breach law, these Terms or our Community Guidelines.
5. Anonymous posts are not anonymous to MOIM
Where MOIM offers an anonymous-posting feature, the feature is designed to hide your identity from other users in the way shown in the app. MOIM may still retain the underlying account linkage for safety, abuse prevention, moderation and legal purposes. Do not use anonymous features to harass, threaten, deceive or evade enforcement.
6. Meetups, events and real-world activity
MOIM helps users discover and organise meetups and events, but MOIM is not the organiser of user-created meetups unless we explicitly say otherwise. You are responsible for deciding whether to attend, checking relevant details and using appropriate judgment when meeting people offline.
MOIM does not guarantee another user’s identity, conduct, suitability, safety or attendance. If a meetup involves commercial activity, regulated services, alcohol, transport, accommodation, medical advice or another higher-risk activity, the organiser is responsible for complying with applicable laws and obtaining any required licence or insurance.
7. Business and organisation accounts
Business and association profiles must accurately represent the organisation they claim to represent. MOIM may request information to verify ownership, authority or eligibility before enabling certain features or displaying a verification indicator.
Business users are responsible for the accuracy of pricing, operating hours, promotions, events, contact information and any claims they publish. MOIM may correct, restrict or remove misleading, outdated or unlawful business information.
Community organisations and moderators must use any elevated permissions only for legitimate community administration and in line with MOIM’s rules.
8. Prohibited conduct
You must not use MOIM to:
- post or facilitate unlawful, fraudulent, threatening, harassing, hateful, sexually exploitative or seriously harmful content;
- target, doxx, stalk or expose another person’s private information without permission;
- impersonate people or organisations, manipulate votes, fabricate engagement or coordinate deceptive activity;
- spam, scrape, harvest user data, send unsolicited bulk messages or use automated tools without written permission;
- upload malware, probe security, bypass access controls, interfere with service operation or attempt to access non-public systems;
- promote illegal goods, services or activity, or use MOIM in a way that breaches another person’s intellectual-property, privacy or other legal rights;
- use reporting, blocking, moderation or anonymous-posting features abusively.

9. Moderation, restrictions and enforcement
MOIM may review reports and take proportionate action to protect users and the service. Depending on the circumstances, this may include limiting visibility, removing content, restricting features, suspending or disabling accounts, removing business or moderator permissions, or preserving evidence needed for an investigation.
We may act without advance notice where reasonably necessary for safety, security, legal compliance or to prevent further harm. Where practical, we may provide a reason or a way to contact support.
10. MOIM intellectual property
MOIM’s software, branding, design, logos, non-user content and underlying technology are owned by or licensed to MOIM PTY LTD and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of MOIM intellectual property to you.
You may not copy, reverse engineer, resell, sublicense or commercially exploit MOIM except as permitted by law or with our written permission.
11. Third-party services and links
MOIM may integrate with or link to third-party services such as sign-in providers, maps, app stores or external websites. Those services are governed by their own terms and privacy practices. We are not responsible for independent third-party services that we do not control.
12. Fees and future paid features
MOIM’s initial consumer app does not include paid in-app purchases. Core business participation may also be offered without charge during launch. If we introduce paid plans, subscriptions, promoted placement or other paid features, we will present the applicable price, billing terms and cancellation conditions before you agree to pay.
13. Availability and changes
We may add, remove or change features as MOIM develops. We may also perform maintenance, respond to incidents or stop supporting a feature where reasonably necessary. We will try to avoid unnecessary disruption but do not promise uninterrupted or error-free availability.
14. Ending your use of MOIM
You may stop using MOIM at any time and can request account deletion through our account deletion page. We may suspend or terminate access where you materially breach these Terms, create safety or security risk, or where continued service would be unlawful.
Sections that by their nature should continue after termination — including intellectual-property rights, lawful retention, dispute provisions and limits that are legally permitted — continue to apply.
15. Consumer rights, disclaimers and liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
To the maximum extent permitted by law, MOIM does not guarantee the accuracy of user-generated content, business listings, meetup information or third-party information, and is not responsible for independent decisions or offline interactions between users.
Where the law permits limitation of liability, MOIM is not liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by your unlawful use, misuse of your account, or third-party conduct outside MOIM’s reasonable control. Any limitation applies only to the extent permitted by law.
16. Governing law and changes to these Terms
These Terms are governed by the laws of New South Wales, Australia, subject to any mandatory consumer or other rights that apply where you live.
We may update these Terms where reasonably necessary for product, safety, legal or operational changes. If a change materially affects your rights, we will provide reasonable notice through the app, website or another appropriate channel before the change takes effect where required.

본 이용약관(“약관”)은 이용자가 MOIM 앱, 웹사이트 또는 관련 서비스를 이용할 때 이용자와 MOIM PTY LTD(“MOIM”, “회사”) 사이에 적용됩니다. 계정을 생성하거나 MOIM을 이용하면 본 약관, 개인정보처리방침, 커뮤니티 가이드라인에 동의한 것으로 봅니다.
동의하지 않는 경우 MOIM을 이용하지 마세요.
2. 이용 자격 및 연령
호주에서는 MOIM 계정을 생성하려면 만 16세 이상이어야 합니다. 다른 지역에서는 해당 지역 법률상 최소 연령을 충족해야 하며, 어떤 경우에도 더 높은 연령 기준이 적용되지 않는 한 최소 만 13세 이상이어야 합니다.
비즈니스, 한인회, 학생회 등 조직을 대신해 MOIM을 사용하는 경우 해당 조직을 대표하거나 해당 기능을 사용할 권한이 있음을 보증합니다.
3. 계정 및 보안
- 정확한 정보를 제공하고 계정 정보를 합리적인 범위에서 최신 상태로 유지해야 합니다.
- 로그인 자격증명을 안전하게 관리하고 일회용 인증코드나 복구 자격증명을 타인과 공유하지 마세요.
- MOIM이 합리적인 보안조치를 취하지 않아 발생한 경우를 제외하고, 원칙적으로 이용자 계정에서 이루어진 활동에 대해 이용자가 책임을 집니다.
- 타인을 사칭하거나, 제한을 우회하거나, 이용자를 속이거나, 운영 조치를 방해하기 위한 계정을 만들 수 없습니다.
- 계정이 탈취되었거나 무단 사용된 것으로 의심되면 즉시 회사에 알려주세요.
4. 이용자 콘텐츠 및 회사에 부여하는 권한
이용자가 MOIM에 직접 작성·제출한 콘텐츠의 권리는 원칙적으로 이용자에게 남습니다. 다만 다른 사람이나 조직이 보유한 권리는 별도로 존중해야 합니다.
MOIM 서비스를 제공하기 위해 이용자는 회사에 전 세계적, 비독점적, 무상 사용권을 부여합니다. 이 사용권은 콘텐츠를 호스팅·저장·형식 변환·표시·전송하고 기술적 사본을 생성하는 등 서비스 제공, 보안, 운영, 개선에 합리적으로 필요한 범위에 한정됩니다. 콘텐츠가 활성 시스템에서 삭제되면 이 권한은 종료되지만 백업, 안전, 법적 의무, 분쟁 대응을 위해 필요한 사본은 제한적으로 유지될 수 있습니다.
이용자는 자신이 제출한 콘텐츠가 타인의 권리를 침해하지 않고 법률, 본 약관, 커뮤니티 가이드라인을 위반하지 않도록 해야 합니다.
5. 익명글은 MOIM에 대해 완전히 익명이 아닙니다
MOIM의 익명 게시 기능은 앱에서 안내하는 방식으로 다른 이용자에게 작성자 신원을 숨기는 기능입니다. 회사는 안전, 악용 방지, 운영 및 법적 대응을 위해 내부적으로 계정 연결 정보를 보유할 수 있습니다. 익명 기능을 괴롭힘, 협박, 기만 또는 제재 회피 목적으로 이용할 수 없습니다.
6. 모임, 이벤트 및 오프라인 활동
MOIM은 이용자가 모임과 이벤트를 찾고 만들 수 있도록 돕지만, 회사가 명시적으로 주최한다고 표시하지 않는 한 이용자 생성 모임의 주최자가 아닙니다. 참여 여부를 결정하고 일정·장소 등 세부 정보를 확인하며 오프라인 만남에서 적절한 주의를 기울일 책임은 이용자에게 있습니다.
회사는 다른 이용자의 신원, 행동, 적합성, 안전 또는 참석을 보장하지 않습니다. 모임이 상업 활동, 규제 서비스, 주류, 교통, 숙박, 의료 자문 등 높은 위험을 수반하는 경우 주최자는 관련 법률을 준수하고 필요한 허가나 보험을 확보해야 합니다.
7. 비즈니스 및 단체 계정
비즈니스·단체 프로필은 실제로 대표한다고 주장하는 조직을 정확하게 나타내야 합니다. 회사는 특정 기능 제공 또는 인증 표시 전에 소유권, 대표 권한, 자격을 확인하기 위한 자료를 요청할 수 있습니다.
비즈니스 이용자는 가격, 영업시간, 프로모션, 이벤트, 연락처 및 기타 게시 정보의 정확성에 책임이 있습니다. 회사는 오해를 유발하거나 오래되었거나 위법한 비즈니스 정보를 수정·제한·삭제할 수 있습니다.
커뮤니티 단체 및 운영 권한을 가진 이용자는 해당 권한을 정당한 커뮤니티 운영 목적으로만 사용해야 합니다.
8. 금지 행위
이용자는 MOIM을 다음 목적으로 사용할 수 없습니다.
- 불법, 사기, 협박, 괴롭힘, 혐오, 성적 착취 또는 중대한 위해를 조장하는 콘텐츠 게시·유통
- 타인의 개인정보를 동의 없이 노출하거나 신상털기, 스토킹, 표적 괴롭힘
- 사칭, 투표 조작, 허위 참여 생성, 조직적 기만 행위
- 스팸, 무단 스크래핑, 이용자 데이터 수집, 대량 메시지 발송, 서면 허가 없는 자동화 도구 사용
- 악성코드 업로드, 보안 취약점 탐색, 접근통제 우회, 비공개 시스템 접근 시도
- 불법 상품·서비스·활동 홍보 또는 타인의 지식재산권·개인정보권 등 권리 침해
- 신고·차단·운영 또는 익명 기능의 악용

9. 운영, 제한 및 제재
회사는 신고를 검토하고 이용자와 서비스 보호를 위해 상황에 비례한 조치를 취할 수 있습니다. 조치에는 노출 제한, 콘텐츠 삭제, 기능 제한, 계정 일시 정지·비활성화, 비즈니스 또는 운영 권한 회수, 조사에 필요한 증거 보존 등이 포함될 수 있습니다.
안전, 보안, 법적 의무 또는 추가 피해 방지를 위해 합리적으로 필요한 경우 사전 통지 없이 조치할 수 있습니다. 가능한 경우 조치 이유 또는 고객지원 문의 경로를 안내할 수 있습니다.
10. MOIM의 지식재산권
MOIM의 소프트웨어, 브랜드, 디자인, 로고, 회사가 제작한 콘텐츠 및 기반 기술은 MOIM PTY LTD 또는 정당한 권리자에게 귀속되며 관련 지식재산권법의 보호를 받습니다. 본 약관은 회사의 지식재산권을 이용자에게 이전하지 않습니다.
법률이 허용하거나 회사의 서면 허가가 있는 경우를 제외하고 MOIM을 복제, 역설계, 재판매, 재라이선스 또는 상업적으로 악용할 수 없습니다.
11. 제3자 서비스 및 링크
MOIM은 로그인 제공자, 지도, 앱스토어, 외부 웹사이트 등 제3자 서비스와 연결될 수 있습니다. 독립적인 제3자 서비스에는 해당 사업자의 약관과 개인정보처리방침이 적용되며, 회사가 통제하지 않는 제3자 서비스 자체에 대해서는 책임지지 않습니다.
12. 요금 및 향후 유료 기능
MOIM의 초기 소비자용 앱에는 유료 인앱 구매가 포함되지 않습니다. 출시 초기에는 핵심 비즈니스 참여 기능도 무료로 제공될 수 있습니다. 향후 유료 플랜, 구독, 추천 노출 등 유료 기능을 도입하는 경우 결제에 동의하기 전에 가격, 청구 방식, 해지 조건을 명확히 안내합니다.
13. 서비스 제공 및 변경
MOIM의 개발 과정에서 기능을 추가·변경·종료할 수 있습니다. 유지보수, 보안 사고 대응 또는 합리적인 운영 사유로 기능이 일시 중단될 수 있습니다. 회사는 불필요한 중단을 줄이기 위해 노력하지만 항상 중단 없이 또는 오류 없이 제공될 것을 보장하지는 않습니다.
14. 이용 종료 및 계정 삭제
이용자는 언제든 MOIM 이용을 중단할 수 있으며 계정 삭제 페이지를 통해 계정 삭제를 요청할 수 있습니다. 이용자가 본 약관을 중대하게 위반하거나 안전·보안 위험을 만들거나 서비스 제공이 위법해지는 경우 회사는 이용을 제한하거나 종료할 수 있습니다.
지식재산권, 적법한 정보 보유, 분쟁 해결 및 법률상 허용되는 책임 제한 등 성질상 이용 종료 후에도 적용되어야 하는 조항은 계속 효력을 가질 수 있습니다.
15. 소비자 권리, 면책 및 책임 제한
본 약관의 어떠한 내용도 호주 소비자법(Australian Consumer Law) 또는 적용되는 다른 법률상 배제할 수 없는 소비자 보장, 권리 또는 구제수단을 배제·제한·변경하지 않습니다.
법률이 허용하는 최대 범위에서 회사는 이용자 생성 콘텐츠, 비즈니스 정보, 모임 정보 또는 제3자 정보의 정확성을 보장하지 않으며, MOIM의 합리적 통제를 벗어난 이용자 간 독립적인 판단이나 오프라인 상호작용에 대해 책임지지 않습니다.
법률상 책임 제한이 허용되는 경우, 회사는 합리적으로 예견하기 어려운 간접·결과적 손실 또는 이용자의 위법한 사용, 계정 오용, 회사의 합리적 통제를 벗어난 제3자 행위로 인한 손실에 대해 책임을 제한할 수 있습니다. 이러한 제한은 법률이 허용하는 범위에서만 적용됩니다.
16. 준거법 및 약관 변경
본 약관은 이용자가 거주하는 지역에서 강행적으로 적용되는 소비자 보호 또는 기타 권리를 제외하고 호주 뉴사우스웨일스주 법률의 적용을 받습니다.
회사는 제품, 안전, 법률, 운영상 합리적으로 필요한 경우 약관을 변경할 수 있습니다. 이용자의 권리에 중대한 영향을 주는 변경은 법률이 요구하는 범위에서 효력 발생 전에 앱, 웹사이트 또는 적절한 방법으로 합리적인 사전 안내를 제공합니다.
